Terms of Service

1. Who we are
ImmortalAI is operated by a company being established in Switzerland. Registered details and a contact address will appear here once incorporation is complete. These terms are governed by Swiss law, and the courts of Switzerland have jurisdiction.
2. Keep your originals
ImmortalAI is not a backup service and must not be your only copy of anything. Keep the original recordings, diaries, letters and photographs. If you have digitised something here, keep the thing you digitised.
We take reasonable care and we will not pretend that is the same as a guarantee. Servers fail, companies fold, and a service that promises permanence is making a promise no software can keep. You can export everything you have stored, at any time, from Settings — we recommend you do so periodically and keep that export somewhere of your own.
3. What you store, and what we can see
You keep ownership of everything you upload. We claim no rights over your memories, and we do not use them to train AI models — not ours, and not anyone else's.
Being straightforward about what we can technically access, because this is where most services are vague:
- Recordings, transcripts, conversations with the AI and exports are encrypted while stored.
- The text of written stories is not encrypted at rest, because search and the AI need to read it.
- We are technically able to access the contents of your vault. We restrict that access to what is necessary to operate and support the service. We are telling you because a service that can read your data and implies otherwise is worse than one that says so plainly.
- When someone on our side opens your account record through our administrative tools, that is recorded — who, when, and what they did. You can read those entries yourself, including the name of the person who looked. This covers our own tools; it is a record of what we do, not a technical barrier, and it does not replace the point above.
- The AI that answers questions about your memories runs on our own servers. Your stories are not sent to OpenAI, Google, Anthropic or any other outside provider.
4. Other people's memories
This is the part that matters most, and the part most likely to cause difficulty.
Much of what people store here was created by someone else — a parent's diary, a grandmother's letters, photographs of people who are still living. When you upload material like that you confirm that you have the right to do so, and that you have considered the people it is about.
You are responsible for what you upload and for whom you share it with. Please think particularly carefully before uploading:
- Private writing by someone who is still alive, without asking them
- Material that reveals private things about living people who have not agreed to it — health, relationships, finances, beliefs
- Anything you do not have the right to copy
A diary is a private document. Digitising it does not make it less private, and inviting family members to a vault gives them access to everything in it.
We are not able to check what you upload, and we do not review it. If someone tells us that material about them is here without a proper basis, we will act on that, which may mean removing it.
5. What the AI is, and is not
The AI answers questions using the stories in a vault. It generates language, which means it can be wrong: it may misread handwriting, mishear a recording, or fill a gap with something that sounds plausible and was never said.
We mark parts of an answer that do not appear in the underlying story, and every answer shows its sources so you can check. Treat what the AI says as a pointer to the memory, not as the memory itself. The recording and the original page are the record. The AI is a way of finding your way around them.
Transcription of speech and handwriting is automatic and imperfect. You can correct any transcript, and we would encourage you to.
6. Accounts and access
- You are responsible for your account and for keeping your password and second factor secure.
- Anyone you invite to a vault can read everything in it. You can withdraw access at any time, which takes effect immediately — though you cannot unsee what has already been read.
- An invitation can only be accepted by the email address it was sent to.
- You must be at least 16 to hold an account.
7. Plans, storage and fair use
The free plan includes 10 stories and 100 MB of storage. Paid plans include unlimited stories and 10 GB of storage, which is intended to be more than a family will use — a lifetime of recordings and a shelf of scanned diaries fits comfortably.
Fair use. That allowance is for preserving one family's memories. It is not general-purpose file storage, a media library, or somewhere to park backups of unrelated material. If usage looks unrelated to what this service is for, we may contact you and, if it continues, limit or suspend the account. We would always rather have the conversation first.
Managing space is up to you: if you reach the limit, remove something or export it and keep it elsewhere.
8. Payment and cancellation
Subscriptions are billed annually or monthly through Stripe. You can cancel at any time and keep access until the end of the period you have paid for. We do not refund part-periods, except where Swiss law requires it.
If a subscription lapses, your memories are not deleted. The account returns to free-plan limits, and you keep the ability to export everything.
9. Ending the service
You can delete your account at any time. Deletion removes your stories, recordings and transcripts from our systems; backups are overwritten on their normal cycle rather than instantly.
If we ever have to shut the service down, we will give you at least 90 days' notice and the ability to export everything before it ends. This is why § 2 asks you to keep your originals.
10. Liability
The service is provided as it is. To the extent Swiss law allows, we are not liable for indirect or consequential loss, and our total liability is limited to what you have paid us in the twelve months before the claim.
Nothing here limits liability for death or personal injury caused by negligence, for intentional wrongdoing or gross negligence, or for anything else that cannot be limited under Swiss law.
We are conscious this sits oddly beneath a page about irreplaceable memories. It is precisely why § 2 says what it says: no clause can give a lost recording back, so please keep your own copy.
11. Data protection
We handle personal data under the Swiss Federal Act on Data Protection, and under the GDPR where it applies. You can access, correct, export and delete your data from within the service. A full privacy notice will be published alongside these terms.
If you store material about other people — which, in a family memory vault, you almost certainly will — you should consider your own responsibilities toward them. See § 4.
12. Changes
We may update these terms. For anything that materially affects you we will give notice in the service before it takes effect. The date at the top always reflects the current version.
